Confidentiality and data storage
Brain Based Safety B.V. observes strict confidentiality (non-disclosure) with regard to all information relating to its clients, ranging from client names and types of assignments to the client’s intellectual and industrial property. This data is not stored. There are three exceptions:
- The client’s name may be mentioned on the website as a client, unless the client explicitly indicates that they do not wish this.
- If the client holds a license for the use of the Toolbox sessions, the client has access—solely for internal monitoring purposes—to usage information per email address (dates and duration of Toolbox use) for the duration of the license.
- If the client commissions a Safety Survey, the IP addresses and/or email addresses of respondents are stored in order to prevent duplicate logins.

Cancellation policy
- Cancellation of individual appointments is free of charge if made at least 48 hours in advance.
- If individual appointments are cancelled within 48 hours, 2 hours will be charged.
- Cancellation of training sessions and activities lasting longer than half a day is free of charge if made at least one month in advance.
- If appointments, training sessions, or activities are cancelled within this period, 100% of the agreed fee will be charged.
Terms of delivery and costs
- Assignments carried out by Brain Based Safety B.V. are always preceded by a quotation describing the mutual obligations.
- Quoted amounts are always exclusive of VAT. For multi-year assignments, the hourly/half-day rate is adjusted annually as of January 1 by a percentage approximately equal to the inflation rate of the previous year.
- Except for open training sessions, travel expenses (€0.50 per kilometer) and, where applicable, accommodation costs (only if agreed in advance) will be charged separately.
- Clients purchasing services from Brain Based Safety B.V. are required to pay invoices within one month, unless a written agreement extends this term to two months. From the moment of default (under Dutch law: one month after the invoice date), Brain Based Safety B.V. is entitled to charge statutory interest of 6% on the outstanding amount. If the client remains in default after formal notice, the claim may be handed over for collection, in which case the client will also be liable for full reimbursement of extrajudicial and judicial costs, including costs incurred by external experts in addition to court-determined costs, related to the collection of the claim or thae exercise of legal rights.
- Any disputes with the client are governed by Dutch law.
Liability
In the course of its activities, Brain Based Safety B.V. may provide advice and may be involved in the design and execution of activities at client organizations. The client, however, remains 100% responsible for the implementation of such advice and the consequences thereof, including in cases where Brain Based Safety B.V. is in any way involved in the execution. The client is therefore always required to thoroughly inform itself of the consequences of implementation. If clients participate in training sessions, including outdoor activities, Brain Based Safety B.V. will take all reasonable measures to ensure safety and to instruct participants accordingly. Participation in such training sessions is, however, always entirely at the risk and responsibility of the client and/or commissioning party. If Brain Based Safety B.V. is held legally liable for damage suffered due to negligence or intent, such liability shall never exceed €1,250,000 per claim, with a maximum of €500,000 for damage caused by fire and/or explosion.
Signing the quotation and accepting the assignment automatically means that the client agrees to the above terms and conditions.
